Welcome to Elite Fleet Cars (hereinafter referred to as “the Company”). By accessing our website, elitefleetcars.co.ke, or by entering into a rental agreement for any of our vehicles, you (the “Hirer”) agree to comply with and be bound by the following Terms and Conditions. These terms are governed by the laws of the Republic of Kenya.
1. Requirements for Hire
To ensure safety and compliance with insurance policies, the Hirer must meet the following criteria at the time of booking:
- Age Limits: The Hirer must be between the ages of 23 and 70 years.
- Driving Experience: The Hirer must possess a valid Kenyan Driving License or a recognized International Driving Permit (IDP) that has been held for a minimum of two (2) years.
- Documentation: Original National ID or Passport must be presented. For self drive car hire, copies of these documents will be retained by the Company for the duration of the hire.
2. Rental Period and Rates
- 24-Hour Cycle: Rental periods are calculated on a 24-hour basis. If a vehicle is picked up at 10:00 AM, it is due back by 10:00 AM on the return date.
- Grace Period: We offer a one-hour grace period. Beyond this, a late return fee or an extra day’s charge will apply.
- Rates: Our car hire in Nairobi with rates displayed on the website are subject to change based on seasonality and vehicle availability. Rates include standard maintenance but exclude fuel, tolls, and parking fees.
3. Payment and Security Deposit
- Booking Confirmation: A non-refundable commitment fee is required to secure any booking car rental.
- Payment Methods: We accept M-Pesa, Credit/Debit Cards, and Direct Bank Transfers. We do not accept cash payments for security reasons.
- Security Deposit: A refundable security deposit is mandatory for all self drive rentals, including the Mazda Demio, Vitz, and 12-16 seater vans. This deposit covers minor damages, fuel shortages, or late return fees and is refunded within 48 hours of vehicle return, subject to inspection.
4. Vehicle Use and Restrictions
The Hirer agrees that the vehicle (whether a luxury vehicle hire or a cheap car rental) shall be used only for lawful purposes. Specifically:
- Prohibited Use: The vehicle shall not be used for racing, towing, or carrying passengers for hire (taxi/matatu services).
- Geographic Limits: Vehicles are restricted to the borders of Kenya. Crossing borders requires prior written authorization and additional “Comesa” insurance.
- Capacity: The Hirer must not exceed the manufacturer’s seating capacity. This is strictly enforced for our 12-seater, 14-seater, and 16-seater vans.
- Off-Roading: Only designated 4×4 car hire nairobi units are permitted for off-road use or entry into National Parks. Sedans like the Honda Fit or Vitz are restricted to paved or well-maintained all-weather roads.
5. Fuel and Maintenance
- Fuel Policy: Vehicles are typically provided with a specific fuel level (e.g., Full-to-Full). The Hirer must return the vehicle with the same level of fuel.
- Fuel Quality: The Hirer must use high-quality fuel from reputable stations (Shell, Total, Rubis). Damage resulting from contaminated or “adulterated” fuel is the sole responsibility of the Hirer.
- Daily Checks: For monthly car rental or long-term hires, the Hirer is responsible for checking oil, coolant, and tyre pressure daily.
6. Insurance and Liability
- Comprehensive Cover: All vehicles are covered by Comprehensive Insurance. However, this cover is subject to an “Insurance Excess” (the deductible).
- Hirer Liability: In the event of an accident where the Hirer is at fault, the Hirer is liable for the insurance excess amount.
- Non-Covered Damages: Insurance does not cover damage to tyres, windscreens, undercarriage, or interior stains/burns.
- Voiding Insurance: Insurance is rendered void if the Hirer is found to be driving under the influence of alcohol or drugs, or if the vehicle was being driven by an unauthorized person.
7. Accidents, Theft, and Breakdowns
- Immediate Notification: The Hirer must notify the Company immediately at 0842337395 in the event of any mechanical failure or accident.
- Police Abstract: In the case of an accident involving a third party, the Hirer must obtain a Police Abstract. Failure to provide a Police Abstract will result in the Hirer being held 100% liable for all repair costs.
- Unauthorized Repairs: The Hirer shall not authorize any repairs or part replacements without the express consent of the Company.
8. Traffic Violations
The Hirer is solely responsible for all traffic fines, speeding tickets, and “instant fines” incurred during the rental period. This includes parking fees in Westlands, Ruiru, Juja, and the Nairobi CBD.
9. Termination of Agreement
The Company reserves the right to terminate the rental agreement and repossess the vehicle without notice if the vehicle is being used in violation of these terms or if there is a risk of loss or damage to the vehicle.
